Inn Paradise – Booking & Website Terms & Conditions
1. General Agreement
By booking accommodation or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, House Rules, and any additional agreements provided by Inn Paradise.
These Terms apply to both:
• Use of the Inn Paradise website (intellectual property, content, linking).
• Guest stays and bookings at properties under Inn Paradise management.
1.1 Role of the Manager: Inn Paradise Holiday Homes ("the Manager") acts exclusively as a guest management and booking agent on behalf of the legal owner(s) of the property ("the Owner").
1.2 Direct Contract: When a Guest completes a booking, the Guest is entering into a direct contract with the Owner of the accommodation. The Manager is not a party to the rental transaction and acts solely to facilitate the booking, payment collection, and guest management services on the Owner’s behalf.
1.3 Limitation of Liability: Because the contract is between the Guest and the Owner, the Manager accepts no liability for any structural defects, property maintenance failures, unexpected property unavailability, or any actions, omissions, or defaults of the Owner. Any claims arising from the physical condition of the property or the tenancy itself must be directed to the Owner via the Manager.

2. Booking & Payment
• All bookings must be paid in full at the time of reservation. Payment is not inclusive of the damage deposit bond, this paid and held on arrival.
• A credit card surcharge may apply to payments. This surcharge reflects our actual cost of processing the transaction and will be displayed at checkout.
• A valid photo ID matching the name on the booking is required for verification prior to check-in.
• Credit card fraud or inappropriate payment disputes will be pursued via debt collection services, which may affect the cardholder’s credit history and rating.
• A security bond is required via a credit card pre-authorization prior to or at check-in. The funds will be held and released within reasonable timeframe after check-out, provided no damages or breaches occur.
• Bonds will be released within a reasonable timeframe after check-out, provided no damage, breaches, or additional charges are incurred.

3. Cancellation & Changes
• No refunds will be issued for any cancellations or shortened stays made within the agreed cancellation period, this is displayed above the breakdown of costs on the payments page. There are no exceptions.
• This policy applies to cancellations, change of mind, and early departure.
• All transactions may be subject to a transaction fee or processing fee. This includes and is not limited to refunds
• If a cancellation is made outside the non-refundable window, a 90% refund will be issued. If a cancellation is made within the non-refundable period, 0% of the booking total will be refunded."

4. Guest Responsibilities & House Rules
• Guest must sign the agreement and complete the check-in form before the check -in date. A valid ID must be provided. A message will be sent to you with all the information once the booking is made.
• Guest agrees to the listings check-in and check-out process, including key collection & key drop off. Check-in: from 3pm | Check-out: 10am (late check-out without approval may result in full bond forfeiture).
• Number of guests must not exceed the confirmed booking. Breach may result in eviction and loss of all payments/bond.
• Strict No Party Policy – excessive noise, parties, or disturbances will result in immediate eviction with no refund.
• Balconies: Guests must not throw objects from balconies, must supervise children at all times, and must lock balcony doors and windows when leaving the property.
• Pets are not allowed unless expressly approved.
• Guests agree to not breach any health or fire regulations or other pertinent laws when residing in our accommodation.
• Any breach of ABG Management PTY LTD trading as Inn Paradise policies may result in immediate eviction with no refund.
• Limited supplies are provided at the beginning of the stay. Additional supplies can be purchased at extra cost.
• The guest agrees that this booking is a short-term holiday stay and does not create any residential tenancy rights under the Residential Tenancies and Rooming Accommodation Act 2008 (Qld)

5. Damages, Cleaning & Bond Forfeiture
• Guests are responsible for any damage, breakage, or loss caused during their stay.
• If damages exceed the bond, Inn Paradise may charge the guest’s credit card or take legal action.
• False fire alarms resulting in Fire Brigade callouts may incur additional fees charged to the guest.
• Lost keys, lockouts, or lock replacements will incur a minimum call-out fee of $150, plus the cost of replacement hardware, payable immediately upon staff attendance.
• When checking out please dispose of all rubbish in the building's designated chutes or bins. All used dishes and kitchenware should be loaded into the dishwasher and the cycle started. Alternatively, please ensure all items are clean, dry, and put away in the cupboards. Please note: An additional cleaning fees may be deducted from the bond for excessive cleaning or untidy conditions left at check-out.
• Smoking is strictly prohibited within the property. A cleaning and deodorising fee will result in forfeited bond if this rule is breached.
• Cleaning is only carried out at check-out. Optional cleaning during stay is available upon request at additional cost. Please ask for a quote if required.

6. Maintenance, Repairs & Outside Factors
• All appliances, amenities, and facilities are provided in good faith by the property owner.
• Guests agree that repairs to facilities or appliances will be carried out within a “reasonable timeframe” and acknowledge that Inn Paradise is not liable for any inconvenience or loss caused by breakdowns or delays.
• Please note that insects and other forms of wildlife are a natural part of the subtropical environment in Surfers Paradise. The presence of insects is not considered a breach of this agreement and is not a valid reason for cancellation or a refund.
• As a bustling, central holiday destination, Surfers Paradise is a lively area with many sources of external noise, including traffic, nearby nightlife, construction noise and other guests within the building. We do not have control over these disturbances, and therefore, external noise is not considered a valid reason for cancellation, refunds, or compensation.

7. Liability & Indemnity
• The Guest acknowledges that they are staying at the property at their own risk. The Host and ABG Management PTY LTD Trading as Inn Paradise are not liable for any death, accidents, injuries, or illness that occur to any guest or visitor while on the premises or using its facilities (including but not limited to stairs, balconies, pools, or outdoor areas). By accepting these terms, the Guest agrees to release the Host and ABG Management PTY LTD Trading as Inn Paradise from all liability and hold them harmless from any claims arising from death, injury, loss, or damage incurred during the stay.
• Inn Paradise is not liable for:
o Temporary failures of services, facilities, or amenities
o Errors or omissions in property descriptions
• Guests are strongly encouraged to obtain travel insurance.

8. Website Use & Intellectual Property
• Unless otherwise stated, Inn Paradise owns all intellectual property rights in website content.
• You may not republish, sell, or redistribute content without permission.
• User comments or reviews must not infringe on third-party rights, contain unlawful material, or be misleading. By posting, you grant Inn Paradise a license to use and reproduce the content.
• Unauthorized use of our logo, branding, or imagery is prohibited.

9. Governing Law & Jurisdiction
• This Agreement shall be construed and enforced in accordance with the laws of Queensland, Australia. The exclusive venue for any action, dispute or proceeding with respect to this Agreement shall be the Queensland Civil and Administrative Tribunal (QCAT) in Southport, without reference to its conflict of law principles. Payment of funds by the guest constitutes consent to the exclusive jurisdiction of QCAT.

10. Privacy Policy
Inn Paradise collects and manages personal information (including photo ID for verification) in accordance with the Australian Privacy Principles. While we implement strict, industry-standard security measures to protect your data, the internet is not entirely secure. By booking, you acknowledge these inherent risks. We will only use your data for booking management, legal compliance, and internal marketing.
11. Amendments
Inn Paradise reserves the right to amend these Terms & Conditions at any time. Continued use of the website or services constitutes acceptance of updated terms.
